The "HAIN HEART MONTH" Contest ("Contest") is brought to you Hain Celestial Canada (the "Sponsor"). Contest Start Date: 12:01 p.m., Eastern Standard Time, February 1, 2010. Contest Close Date: 11:59 p.m., Eastern Standard Time, February 28, 2010. 3. HOW TO ENTER: To enter the contest, visit www.hain-celestial.ca and follow the contest link. Follow the registration instructions and submit your own pledge for positive change for your chance to win. Contestants can also follow the contest on Facebook and Twitter. By joining the HainCelestial group on Facebook, you can follow the link to submit your own pledge and enter the contest. ENTRY LIMIT: You may enter the contest as many times as you like, provided that you enter with a unique holiday horror story each time. Contestants may only enter the contest under a single e-mail address. 4. PRIZES:
4.1 GRAND PRIZE DETAILS There are five (5) Hain Heart Health Gift Baskets to be awarded as the Grand Prize. Total approximate value of the Grand Prize is one hundred and twenty five dollars in Canadian currency ($125.00 CDN). 5. ADDITIONAL PRIZE DETAILS 5.1. The Grand Prize must be accepted as awarded and is not transferable or convertible to cash. No substitution is possible, except in the Sponsor's sole and entire discretion. Any portion of a Grand Prize not accepted by the Winner will be forfeited. The Sponsor reserves the right to select or make substitutions for accommodation in its sole and entire discretion. The Sponsor will not be responsible if any event results in the cancellation of the Grand Prize or if other factors beyond its reasonable control prevent the Grand Prize or any part of the Grand Prize from being fulfilled. By accepting the Grand Prize, the Winner acknowledges that the only warranties applicable to any aspect of the Grand Prize, if any, are the warranties provided by the supplier of the Grand Prize to the Sponsor that are transferable and/or the manufacturer's warranty. In no circumstance whatsoever, the Winner shall have any recourse against the Sponsor in respect of any warranty of the Grand Prize. 5.2. The gift basket and its contents will be sent to the Grand Prize Winner by a courier company. 6. ELIGIBILITY: The contest is open to legal residents of Canada, excluding Quebec, who are over the age of majority in their province. To enter the Contest online, you must have Internet access, and a web browser that is compatible with Microsoft Internet Explorer 6.0 or higher, Firefox 2.0 or higher, Chrome .2 or higher Opera 5.0 or higher Safari 4 or higher. You are not eligible if you are an employee, agent, successor, or assignee of Sponsor, their advertising or promotional agencies; or if you are domiciled with any of the above persons. For participants who do not have Internet access via a personal computer, your local library or Internet Café may be able to provide access to the Internet. Some service providers offer free email service and Internet access. If a potential winner is found to be ineligible, declines to accept the prize, or in the event that a prize confirmation is returned as undeliverable, the prize will be forfeited. Potential Winners MAY be required to furnish proof of identification that may include a driver's license. Before being declared a winner, eligible Winners and Companions, MAY be required to sign a Declaration of Compliance with the Official Rules, a Declaration of Eligibility, and Release of Liability and Publicity, releasing Sponsor, their advertising and promotional agencies, the Prize Suppliers, and all of their respective affiliates, directors, officers, owners, partners, employees, agents, representatives, successors and assigns (collectively, the "Releasees") from any liability or claims in connection with this promotion or their prize. Declaration and Release documents must be returned within (14) business days of notification, or prize will be forfeited and potential winner disqualified. By accepting or participating in a prize, entrants consent to the use by Releasees of their names, voices, statements, photographs or other likenesses, without further compensation or notice, in any publicity and / or media carried out by Sponsor of Releasees in connection with this promotion. 7. HOW TO CLAIM YOUR PRIZE: In order to be declared a Winner of any prize the potential Winner must correctly answer a time-limited, mathematical skill-testing question to be administered online, or via telephone, once your potential winning entry has been received. Allow 4-6 weeks for verification and shipment of your prize. Prize is not transferable or convertible to cash and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, who reserves the right to substitute a prize of equal or greater value. Prize will only be delivered to the verified winner. 8. CONDITIONS OF ENTRY: Entrants acknowledge compliance with these Official Rules including all eligibility requirements. Entrants who have not complied with these Official Rules are subject to disqualification. By entering the contest, each selected entrant agrees to the publication, reproduction and/or other use of his/her name, address, voice, submitted story, statements about the contest and/or photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet. Sponsor and Releasees are not responsible for late, lost, damaged, misdirected, illegible or incomplete entries. Proof of transmission does not constitute proof of delivery. The decisions of the contest judges with respect to all aspects of this contest are final and binding on all entrants without right of appeal. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. If a dispute arises regarding who submitted an online entry, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. Entrants and/or winners assume liability for injuries caused, or claimed to be caused by participating in the promotion, by the acceptance, possession, or use of any prize awarded, including but not limited to claims/damages for personal injury, or property damage. 9. CONTEST OPERATION: Any Contest entry mechanism, or any other materials used in this promotion that have been tampered with, altered, reproduced, not legitimately obtained, or which contain or reflect any error will be void. Without limiting the release of liability provisions herein, and for greater certainty, the Sponsor and Releasees will not be liable for: a) any incorrect or inaccurate information, whether caused by Contest website users or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest; b) any error, omission, interruption, deletion, defect or delay in operation of the Contest website or any transmission in connection with the Contest; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of e-mail which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to entrants' or to any other person's computer related to or resulting from participating or downloading materials in this Contest. If the Contest is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever, Sponsor reserves the right in their sole discretion to, without advance notice, terminate or suspend the Contest, or modify the Contest Rules, in whole or in part, in any way, at any time. Sponsor and Releasees are not responsible for any problems that may arise, including but not limited to, technical malfunctions of telephone network or lines, computer online systems, servers or providers, computer equipment or software, viruses, bugs, failure of personal computers and/or software and hardware configurations, or failure of any email to be received by Sponsor or a participant for any reason including but not limited to traffic congestion on the Internet or at any website or combination thereof. Sponsor and Releasees are not responsible for damage to a user's system occasioned by participation in this promotion or downloading any information necessary to participate in this promotion. All entries become the property of the Sponsor. In the event that, as a result of a computer error, printing or other error, more prizes are claimed than are intended to be awarded according to these Official Rules, prizes will stop being awarded when the Sponsor becomes aware of an error respecting the number of prizes, and there will be a random drawing on January 15th, 2010 amongst all eligible and approved prize claimants whose claims have not yet been redeemed, to award the remaining number of advertised prizes. In no event will the Sponsor or Releasees be liable for more than the stated number of prizes in Rule #4. The Sponsor reserves the right, in its sole discretion, to cancel, suspend or modify the Contest at any anytime during the contest period should any situation beyond the Sponsor's control, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest. Sponsor reserves the right in their sole discretion to disqualify any individual from the Contest, and to ban that individual from any future promotion of Sponsor, if Sponsor finds or believes such individual to be tampering with the entry process or the operation of the Contest or where applicable, the Contest website; to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass Sponsor, Sponsor' agencies, other entrants or any other person.
